Terms of Sale

The terms that govern your purchase from perfumeagency.com. We've kept this short and written it in the same plain English we use everywhere else on the site. Please read it before you order.

1. Acceptance

By placing an order on perfumeagency.com, you confirm that you've read these terms and agree to them. If you don't agree, please don't place an order. If anything below is unclear, email support@perfumeagency.com before checking out and we'll explain.

2. Who we are

Perfume Agency, LLC is a private company registered in New York, address 611 Broadway, Suite 308, New York, NY 10012. We make a single fragrance — the Signature eau de parfum — offered in three sizes, sold directly to consumers through this website only. We have no retail partners. If you see our fragrance being sold somewhere else, please let us know.

3. Pricing and product information

Prices listed on the site are in U.S. dollars. Sales tax (where applicable) is calculated at checkout based on your shipping address. We try to keep product photos, descriptions, and note breakdowns accurate, but fragrance is subjective: longevity, projection, and the way the notes read will vary with your skin chemistry, the weather, and how much you apply. Promotional pricing may end without prior notice.

If we make a pricing error

Occasionally a typo means a size is listed for less than we intend to sell it. If we catch the error before shipping, we'll email you and offer either a refund of your full payment or a chance to pay the difference. We do not silently bill you more than the price you saw at checkout, ever.

4. Order acceptance

Your checkout submission is an offer to buy. We accept the offer when we send you the order confirmation email. Until that email lands, we have not entered into a contract with you and we reserve the right to refuse any order — for example if a size is sold out between batches, if the billing and shipping addresses don't match in a way that suggests fraud, or if your account history shows excessive returns. We will issue a full refund in any case where we refuse.

5. Payment

We accept all major U.S.-issued credit cards through our payment processor. Payments are charged at the moment the order is placed, not at shipment. If your card is declined, the order is canceled — we will not retry the charge.

6. Shipping

Free ground shipping in the contiguous 48 states on orders over $45 (so the 50ml and the Discovery Trio ship free; the 30ml carries a flat $6 ground charge). Orders typically ship within 2 business days of receipt and arrive 3 to 5 business days later. Alaska, Hawaii, APO/FPO, and international addresses are available with a surcharge applied at checkout. Because fragrance contains alcohol, it ships by ground only, which is why we don't offer overnight air. Risk of loss transfers to you when the carrier marks the package as delivered. If your tracking shows delivered but you don't have the package, please contact us within 7 days and we'll work with the carrier to resolve.

7. The 30-day "wear it first" window

Fragrance is personal, and a description can't tell you how a scent will read on your skin. So our window is built around actually wearing it: you have 30 days from delivery to live with the bottle and decide. Unlike most fragrance sellers, we accept opened and partially used bottles within this window — we'd rather you wear it for a week and be sure than gamble blind. Start a return by emailing us (see below) and we'll take it from there.

8. Returns and refunds

To start a return, email support@perfumeagency.com with your order number within the 30-day window and we'll send a prepaid label (lower 48) or instructions for international returns, which the customer ships at their own cost. You don't need to send back an unused bottle — a partially used one is fine within the window.

Refunds land on the original payment method within 5 business days of us receiving the return. We refund the full purchase price. The wear-it-first window is intended for genuine "this scent isn't for me" returns and is limited to one per household per scent; if you've returned a bottle to us before and then order the same scent again, the second order is final. We reserve the right to decline a refund on a bottle that is effectively empty or has been tampered with or refilled.

9. Our satisfaction guarantee

Every order is covered by our wear-it-first satisfaction guarantee: if the Signature simply isn't for you, the return window above makes you whole, no hard feelings. Separately, if a bottle arrives damaged, leaking, or defective — a cracked bottle, a faulty atomizer, or a fragrance that smells off or "turned" — that's on us regardless of the return window. Email support@perfumeagency.com with your order number and a quick photo and we'll replace it or refund it, including shipping, no questions asked.

What is not covered

10. Proper use

Fragrance is for external use on skin and clothing only. Keep it away from eyes and out of reach of children, store it away from open flame and direct heat, and discontinue use if irritation occurs. The Signature is formulated to IFRA standards for safe topical use, but if you have known fragrance sensitivities, patch-test on your inner arm first. The product is not intended to be ingested.

11. Acceptable use of the website

You may not (a) attempt to access any non-public area of the site, (b) interfere with the operation of the site, (c) use any automated scraper or bot to harvest content or pricing, or (d) submit fake orders or test-card transactions. All site content — photographs, scent descriptions, the brand name, the logo — is copyright Perfume Agency, LLC and may not be reused without our written permission.

12. Limitation of liability

To the maximum extent allowed by law, our total liability to you for any claim arising out of or in connection with your purchase is limited to the amount you paid for the products in question. We are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits any liability that cannot be limited under applicable consumer protection law — including any liability for a defective product.

13. Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute that can't be resolved through good-faith conversation will be submitted to binding arbitration in New York County, New York, except that either party may bring a small-claims action in any court of competent jurisdiction. You retain all rights you have as a consumer under your home state or country's law; nothing here waives those.

14. Changes to these terms

We may update these terms occasionally to reflect changes in our business or in the law. We post the updated version here with a new "Last updated" date. Changes apply to orders placed after the update — orders already in flight are governed by the terms in force when you checked out.
